f) If the Product is returned to NMP during the limited warranty
p erio d, bu t the pro blem w ith the Prod u c t is n o t c ov ered u n der th e
terms and con ditions of this limited warr anty, th e Con sumer will
be notified and given an estimate of the charges the Consumer
mu st pay to have the Pro du ct repaired , w ith all ship ping ch arges
b ille d to th e Co n su mer . If th e estim ate is refu sed , th e Pro duct w ill
b e retu rn e d freig ht c o lle c t. If th e Pr o d u c t is r e turn ed to N M P a fter
the expiration of the limited warranty period, NMP's normal
service policies shall apply and the Consumer will be responsible
for all shipping charges.
9. The Product consists of newly assembled equipment that may
contain used components that have been reprocessed to allow
machine compliance with Product performance and reliability
specifications.
10 . AN Y IM PLIED WARRANTY OF M ERCHANTABILITY, OR FITNESS
FOR A PARTICULAR PURPOSE OR USE, SHALL BE LIMITED TO THE
DURATION OF THE FOREGOING LIMITED WRITTEN WARRANTY.
OTHERWISE, THE FOREGOING LIMITED WARRANTY IS THE
CONSUMER'S SOLE AND EXCLUSIVE REMEDY AND IS IN LIEU OF
ALL OTHER WARRAN TIES, EXPRESS OR IM PLIED. NMP SHALL NOT
BE LIABLE FOR SPECIAL, INCIDENTAL OR CONSEQUENTIAL
DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF
ANTICIPATED BENEFITS OR PROFITS, LOSS OF SAVINGS OR
REV EN U E, PU N ITIVE DAMA GES, LOSS OF USE OF TH E PRODU CT OR
ANY ASSOCIATED EQUIPMENT, COST OF CAPITAL, COST OF ANY
SUBSTITU TE EQUIPMEN T OR FACILITIES, DOW N TIME, TH E CLA IMS
OF AN Y TH IRD PARTI ES, I N CLU DIN G CUSTOMERS, AN D I N JURY TO
PROPERTY, RESULTING FROM THE PURCHASE OR USE OF THE
PRODUCT OR ARISING FROM BREACH OF THE WARRANTY,
BREACH OF CONTRACT, NEGLIGENCE, STRICT TORT, OR ANY
OTHER LEGAL OR EQUITAB LE TH EORY, EVEN IF NM P KNEW OF THE
LIKELIHOOD OF SUCH DAMAGES. N M P SH ALL N OT BE LIABLE FOR
DELAY IN RENDERING SERVI CE UNDER THE LI M ITED WARRANTY,
OR LOSS OF USE DURING THE PERIOD THAT THE PRODUCT IS
BEING REPAIRED.
11. Some states do not allow limitation of how long an implied
warranty lasts, so the above one-year warranty limitation may
not apply to you (the Consumer). Some states do not allow the
ex clusion or limitation of inciden tal an d consequ ential damages,
so certain o f th e ab ov e limita tio n s o r ex c lu sio ns ma y n o t ap p ly to
you (the Consumer). This limited warranty gives the Consumer
sp ecific leg al r ights and the Consu mer may also h av e oth er r ights
which vary from state to state.
12. NMP neither assumes nor authorizes any authorized service
center or any other person or entity to assume for it any other
ob lig atio n o r liability bey on d th at which is ex pressly prov ided fo r
in this limited warranty including the provider or seller of any
extended warranty or service agreement.
